This quarter in the Motor world we look at a variety of topics as follows:-

Electric Vehicles: With the numbers of electric vehicles on the roads rising year on year, plus further government incentives to increase usage, it is a good time to look at some of the issues around the use of EVs. E-Scooters: The lack of regulations on e-scooters has been an ongoing source of frustration for insurers as accidents and injuries continue to soar.  The MIB has been picking up the bill for some of these claims in the meantime but they are also running out of patience. Our government acknowledge that this is a significant area of concern which needs to be addressed, but other more important priorities are taking up legislative time instead.   Until then, insurers and lawyers must stay alert to the implications of illegality defences. Split Liability Offers and Part 36: The judgment in Mundy v TUI UK Ltd [2023] EWHC 385 (Ch) prompted a debate on whether split liability offers were still an effective tool in the arsenal of litigators. Some commentators took the view that the judgment was an aberration, whilst others heralded the end of split liability offers. This article considers the practical effect of the decision on the landscape of civil disputes, and offers some suggestions on how practitioners might use or respond to split liability offers while further clarification on the ambit of the judgment is awaited.
