Retail, Food & Hospitality Important updates

Multidirectional attack on misleading pricing and unfair selling practices: The Competition and Markets Authority has announced the launch of a major campaign against the use of what it sees as misleading and unfair consumer market pricing practices. The Competition and Markets Authority which has the powered under the Digital Markets and Consumers Act 2024 to issue penalties of up to 10% of global turnover has initiated enforcement investigations of 8 businesses and sent warning letters to 100 more over ‘drip pricing’ and unfair use of ‘time clocks’ and other time pressure advertising tactics. The CMA has also issued revised guidance on pricing practices and revised its guidance on Unfair commercial practices. Press release > Collection > Guidance >

  • The Department for Business and Trade has pledged to introduce primary legislation when parliamentary time permits to ban the resale of tickets for live events at a profit. Consultation outcome > New rules > Press release >
  • The Department for Business and Trade has published guidance on new rules from 1 January that require businesses operating consumer saving schemes to set out the steps they take to protect participants money. View >
  • The Department for Culture Media and Sport has issued voluntary guidance for the operators of ‘prize draws’ warning that it may be minded to introduce regulation if the guidelines are not followed. View >
  • The Advertising Standards Authority has upheld complaints about the use of ‘from prices’ by accommodation providers due to lack of availability of rooms at the lowest advertised prices. Travelodge > Hilton worldwide >

OFCOM Publish update on actions to enforce ‘Age assurance’: Ofcom has issued a £50,000 fine against the provider of a nudification site for failing to use age-checks to protect children from online pornography, and 20 more porn services have been targeted for enforcement. View >

EU Court of Justice: Rule that EU Commission cannot grant blanket extensions to authorisation periods for plant protection products and must consider the merits of extensions for each product. View >

EU Council and Parliament: Reach agreement for the updating of requirements for measuring instruments. View >
