Consultation launched on allergen labelling for non-prepacked foods in Scotland: Food Standards Scotland has launched a consultation about the provision of ingredients and allergen labelling for non-prepacked foods sold through premises such as restaurants, cafés, takeaways, bakeries and butchers. FSS is exploring how written information could be strengthened, made more consistent and more accessible for consumers across Scotland. White paper and consultations published on regulating the safety of Construction products: The Ministry of Housing Communities and Local Government has published a white paper on the regulation of Construction products. MCLG is consulting on the proposed introduction of a general product safety requirement for construction products that are not otherwise covered by specific regulations. Key proposals include:
mandatory risk assessment: Manufacturers must identify and assess safety risks in relation to a product’s intended and reasonably foreseeable conditions of use and implement proportionate mitigation measures
product information: Clear, accurate, and complete information must be provided, including detailing the intended use, technical specifications, installation guidance, safety warnings and restrictions of use. Marketing claims about safety must be evidence-based
labelling and traceability: Products must carry unique identifiers and manufacturer and (where applicable) importer details, supported by digital solutions, such as QR codes, barcodes, or similar, to enable traceability to facilitate recalls
record keeping: Manufacturers and importers must retain risk assessments, product documentation, and safety incident records for 10 years to support accountability and enforcement
storage and transportation: Economic operators must ensure that construction products are stored and transported in ways that maintain their safety and integrity
obligations for importers and distributors (including merchants): These importers and distributors must verify compliance, maintain records, and implement controls to prevent unsafe products from entering the market
monitoring safety issues: Economic operators must monitor products to identify and address safety risks, investigate and record complaints, and take corrective actions such as amending information or enabling the withdrawal of unsafe products from the market
Competition watchdog launches publicity campaign for businesses on pricing transparency: The Competition and Markets Authority has launched a publicity campaign aimed at businesses to encourage transparency in pricing. Fronted by Alexander Armstrong the campaign advises businesses to show the total price upfront, to include all mandatory charges and if this is not possible to be clear as to how the final price will be calculated.View >

European Court rules UK Trademark rights no longer give protection in EU: The EU Court of Justice ruled following an earlier successful opposition by a Japanese business to the registration of an EU Trade mark on the basis that unregistered designs had been in use in the UK market constituting a ground for refusal under EUIPO rules. The EUCJ ruled that following conclusion of the EU exit transition period rights based on UK law can no longer be relied on to support a ground for refusal of registration under EU law.View >
EU Simplifies sustainability reporting and due diligence requirements: The legislation simplifies the directives on corporate sustainability reporting (CSRD) and corporate sustainability due diligence (CS3D) by reducing the reporting burden and limiting the trickle-down effect of obligations on smaller companies. The CSRD’s scope is narrowed by raising its thresholds to companies with more than 1,000 employees and above €450 million net annual turnover.
