Advertising watchdog deals with more cases under new code provisions on high fat, salt and sugar foods: The Advertising Standards Authority has ruled that advertising for the McDonalds delivery service did not breach the rules on promotion of high fat, salt and sugar foods because the products named in the advertising were not foods high in fat, salt and sugar. Advertising for Bubbleology was found not to breach the code as the company was able to prove that it had less than 250 employees at the relevant time and as such its advertising was exempt from the code provisions.

 

An advertisement for Domino’s ‘Cheeky little pizzas’ was found in breach of the code as some of the products included in the range were in fact found in error to have been high fat and sugar foods. Advertising for coffee by Higham Miller Coffee Ltd was found to contain unauthorised health claims and prohibited endorsement by a medical professional. Health and Safety Executive highlight dust and manual handling prosecution: The Health and Safety Executive have published details of a £120k fine imposed on a plant bakery operated by Puratos Ltd in respect of unsafe practices, including asthma causing dust escaping from machinery due to leaks, the use of compressed airlines to blow down dust deposits and dry sweeping using brushes and brooms.

 

The investigation also found that workers were required to manually lift 25kg sacks of ingredients on a daily basis. Repeated manual handling of heavy loads can lead to musculoskeletal injuries and should be avoided where reasonably practicable. View >

EU updates

EU Commission fines Ali Express and Google under Digital Markets Act: The EU Commission has imposed penalties of 550 million Euro on Ali Express for falling short of its obligation under the DSA to diligently assess the risk of dissemination of illegal, unsafe, or counterfeit products through its services in multiple ways including:

  • Not properly evaluating whether it had sufficient staff to review potentially illegal products.

  • Inadequately assessing how its recommender and advertising systems exacerbate the spread of illegal products.

  • Lacking quantitative metrics in its assessment.

  • Failure to mitigate identified systemic risks

The EU Commission has fined Google 890 million euro in respect of non-compliance by Google with the Digital Markets Act (DMA) for self-preferencing its own services on Google Search, and for putting in place restrictions on businesses to direct consumers to alternative, often cheaper, purchase channels on Google Play (steering).
